These terms govern use of the Enerlytics websites, dashboards, subscriptions, and related services.

Acceptance of terms
By accessing or using Enerlytics, you agree to these Terms of Use. If you do not agree, do not use the service.
These terms apply to our websites, dashboards, beta programs, APIs, notifications, and any related products or services we provide.
Eligibility and accounts
You must provide accurate registration information and keep it current. You are responsible for maintaining the confidentiality of your account credentials, API keys, and connected integrations.
- You may not share credentials or API keys outside your organization unless your plan expressly allows it.
- You are responsible for all activity that occurs under your account, whether performed by you, your team, or an automated integration you authorize.
- You must notify us promptly if you believe your account, notification channel, or API key has been compromised.
Use of the service
- You may use the service only in compliance with applicable law and these terms.
- You are responsible for activity conducted through your account and for keeping account credentials secure.
- You may not reverse engineer, disrupt, abuse, or attempt unauthorized access to the service or its underlying systems.
- You may not use the service to build a competing product, benchmark the service for public comparison without permission, or probe the service for vulnerabilities.
Market intelligence and no advice
Enerlytics provides market intelligence, analytics, commentary, alerts, and software tools for informational purposes only. Nothing on the site or in the product is investment, trading, legal, accounting, or tax advice, and no content should be treated as a recommendation to buy, sell, hedge, or hold any security, commodity, derivative, or other instrument.
We are not acting as your broker, dealer, commodity trading advisor, investment adviser, fiduciary, or agent unless we separately agree to that in writing. Markets are risky, data may be delayed or incomplete, and no model, signal, or workflow can guarantee performance or prevent loss.
Third-party data and API restrictions
Some portions of the service rely on third-party data, market infrastructure, or cloud providers. Your use of the service must respect those dependencies and any contractual or technical restrictions that apply to them.
- Unless we explicitly permit it in writing, you may not resell, sublicense, mirror, redistribute, bulk export, scrape, or republish the service or any raw data delivered through it.
- You may not use the service or API to reconstruct, extract, or substitute for a third-party vendor feed, exchange feed, or underlying dataset.
- We may limit, suspend, or revoke access to any dataset, endpoint, or feature to comply with vendor restrictions, legal obligations, or operational needs.
Beta features and availability
Some features may be marked beta, preview, experimental, or limited release. Those features may change more quickly, contain defects, or be withdrawn without notice.
We do not guarantee uninterrupted availability, timeliness, accuracy, or fitness for a particular purpose. Planned maintenance, vendor outages, market-data issues, and infrastructure failures may affect the service.
Subscriptions and billing
Paid plans, trials, and subscriptions may be offered through third-party billing providers. By subscribing, you authorize us and our billing providers to charge the applicable fees, taxes, and renewals in accordance with the plan you selected.
Feedback, submissions, and communications
If you send us product feedback, support requests, feature ideas, or workflow examples, you grant us a non-exclusive, worldwide, royalty-free license to use that feedback to operate and improve the service, without additional compensation to you.
You are responsible for ensuring that any content, prompt, file, or data you submit does not violate law or third-party rights and that you have the authority to share it with us.
Intellectual property
The Enerlytics service, including software, branding, visual assets, charts, copy, and other content we create, is owned by Enerlytics or its licensors and is protected by applicable intellectual property laws.
Suspension and termination
We may modify, suspend, restrict, or discontinue any part of the service at any time. We may suspend or terminate accounts or API keys that create security risk, violate these terms, exceed plan allowances, or create licensing or legal exposure for us or our providers.
Indemnity
To the extent permitted by law, you will indemnify and hold harmless Enerlytics, its affiliates, and their respective officers, employees, and contractors from claims, damages, losses, and expenses arising from your misuse of the service, violation of these terms, violation of law, or infringement of another party's rights.
Limitation of liability
To the maximum extent permitted by law, Enerlytics and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, business opportunities, or trading losses arising from your use of the service.
To the maximum extent permitted by law, our aggregate liability for claims relating to the service will not exceed the greater of the amount you paid us for the service in the 12 months before the claim arose or one hundred U.S. dollars (US$100).
Changes to these terms
We may update these terms from time to time. Continued use of the service after changes become effective constitutes acceptance of the updated terms.
